These are the Terms and Conditions of Use that regulate your relationship with Abun Technologies Private Limited, also known as ‘Abun.com’, ‘Abun’, ‘we’, ‘us’, ‘Platform’, ‘Company’, or ‘our’. By using Abun or registering for an account, you agree to the terms and conditions which will result in a legal agreement between you and Abun.com. These Terms are meant to inform Users about the limitations and requirements that must be considered and followed when using Abun services.
Any registration on the Platform means an unconditional acceptance of the Terms and Conditions, which the User acknowledges having read and understood. You should not use the Service if you breach these Terms of Service or if you do not agree to these Terms of Service.
All terminologies in the Terms and Conditions must be read in conjunction with the Privacy Policy.
1. Usage Rights & License
1.1 Scope of Use
1.1.1 Personal and Commercial Use
Upon agreeing to these Terms & Conditions, users are granted a limited, non-exclusive, non-transferable, and revocable license to use our AI product (hereinafter referred to as “the AI”) for personal and, if applicable, commercial purposes as outlined below:
Personal Use: Users are permitted to use the AI for personal purposes, such as generating content for personal projects, education, or non-commercial sharing, provided that such use does not violate these Terms & Conditions.
Commercial Use: Users who wish to use the AI for commercial purposes (e.g., generating content for business, marketing, resale, or distribution) must do so in accordance with the specific licensing terms provided at the time of subscription or purchase and must comply with all applicable laws and regulations in their jurisdiction.
1.1.2 License Restrictions
The license granted to users under these Terms & Conditions is subject to the following restrictions:
Users may not sublicense, sell, lease, rent, or otherwise transfer the rights granted to them under this license to any third party without our express written consent.
Users may not modify, adapt, translate, or create derivative works based on the AI or its outputs, except as expressly permitted by these Terms & Conditions.
1.2 Prohibited Uses
1.2.1 Illegal Activities
Users are strictly prohibited from using the AI for any illegal activities. This includes, but is not limited to, using the AI to:
Create, disseminate, or promote content that violates any local, national, or international laws or regulations.
Engage in activities that infringe on the rights of others, including intellectual property rights, privacy rights, and contractual rights.
1.2.2 Harmful Content
Users may not use the AI to generate or distribute content that is harmful, offensive, or otherwise objectionable. Prohibited uses include, but are not limited to:
Creating or distributing content that is defamatory, obscene, abusive, threatening, harassing, or otherwise violates the rights or dignity of any person or group.
Promoting violence, hate speech, discrimination, or any form of exploitation.
1.2.3 Security and Misuse
Users may not attempt to bypass, disable, or interfere with any security features of the AI or its associated systems. Prohibited actions include, but are not limited to:
Accessing or attempting to access the AI in a manner that violates these Terms & Conditions, such as using automated tools, bots, or scripts to interact with the AI.
Attempting to reverse-engineer, decompile, or otherwise gain unauthorized access to the underlying code, data, or algorithms of the AI.
2. Content Generation
2.1 Accuracy and Reliability
While our AI product is designed to provide accurate and reliable information, it is important to understand that the AI operates using advanced machine learning models, which may not always produce correct, complete, or appropriate responses. The AI generates content based on patterns and data from various sources, which may include publicly available information, proprietary data, and user input. However, these sources may contain inaccuracies or outdated information, and the AI’s interpretation of this data can sometimes lead to errors.
2.1.1 No Guarantee of Accuracy
We do not guarantee the accuracy, completeness, or reliability of the information generated by the AI. The AI’s outputs should be considered as informational or illustrative, and not as authoritative or definitive statements. Users are advised to independently verify any information generated by the AI, especially before relying on it for any purpose where inaccurate or incomplete information could result in harm or significant consequences.
2.1.2 User Responsibility
Users are solely responsible for any decisions or actions taken based on the content generated by the AI. We shall not be liable for any damages or losses that may arise from the use of or reliance on the AI’s outputs. This includes, but is not limited to, decisions related to personal, financial, legal, medical, or other professional matters.
2.1.3 Inappropriate Content
The AI may generate content that some users find inappropriate, offensive, or otherwise objectionable. While we strive to minimize such occurrences through careful training and moderation, it is not possible to completely eliminate the risk. Users are encouraged to report any content they find problematic, and we will take appropriate action to address the issue. However, we disclaim any responsibility for content generated by the AI that may be considered inappropriate or offensive.
2.2 No Professional Advice
2.2.1 Disclaimer of Professional Advice
The AI is not a licensed professional and does not provide legal, medical, financial, or any other professional advice. The information generated by the AI should not be construed as professional advice and should not be relied upon for making important decisions. Users are advised to consult with a qualified professional in the relevant field before making decisions that could impact their legal rights, financial status, health, or well-being.
2.2.2 No Substitute for Professional Consultation
The AI’s outputs are intended to assist users by providing general information and facilitating certain tasks. However, they are not a substitute for professional consultation or services. Users should not delay seeking advice from a qualified professional because of any information generated by the AI. In cases where specific professional advice is required, users should seek out and rely on the expertise of a qualified individual or entity.
2.2.3 Limited Liability for Professional Matters
We expressly disclaim any liability for actions or decisions taken by users based on the AI’s outputs in professional contexts. This includes, but is not limited to, legal, medical, financial, or business-related decisions. Users assume all responsibility for the outcomes of their decisions and agree to hold us harmless from any claims, damages, or losses that may arise as a result of relying on the AI’s content.
3. Privacy & Data Protection
3.1 Data Collection
3.1.1 Types of Data Collected
When you use our AI product, we may collect various types of data to improve our services, enhance user experience, and ensure the proper functioning of the AI. The types of data we collect include:
Personal Information: This may include your name, email address, contact details, and payment information when you register for an account, subscribe to services, or make purchases.
Usage Data: We may collect data about how you interact with the AI, including the frequency and duration of use, the features you access, and the content you generate.
Device and Technical Data: This includes information about the device you use to access the AI, such as your IP address, browser type, operating system, and other technical identifiers.
3.1.2 Purpose of Data Collection
The data we collect is used for the following purposes:
Service Provision: To provide, maintain, and improve the AI and its associated services.
User Support: To respond to user inquiries, troubleshoot issues, and offer customer support.
Personalization: To personalize the user experience by tailoring the AI’s responses and features to your preferences and past interactions.
Analytics and Research: To analyze user behavior, monitor the effectiveness of the AI, and conduct research to improve our technology and services.
Compliance and Legal Obligations: To comply with legal obligations, enforce our terms, and protect the rights and safety of our users and our company.

Storage: User-Generated Data may be stored temporarily or permanently to enhance the AI’s performance, enable session continuity, and support ongoing product improvement. However, we strive to minimize the storage of personally identifiable information.
Anonymization: Where possible, we anonymize User-Generated Data to prevent it from being linked back to specific individuals. Anonymized data may be used for research, training, and development purposes.
Data Retention: User-Generated Data is retained only for as long as necessary to fulfill the purposes outlined in this policy or as required by law. Users may request the deletion of their data, subject to legal and contractual obligations.
3.2.2 User Control and Access
Users have the right to access, modify, or delete their User-Generated Data. Requests to exercise these rights should be directed to our customer support team, and we will respond within a reasonable timeframe. Certain data may be exempt from deletion requests if it is necessary for legal compliance, dispute resolution, or enforcing our terms.

3.3 Security Measures

We take the security of your data seriously and implement a range of technical, administrative, and physical measures to protect it from unauthorized access, disclosure, alteration, and destruction. Our security protocols include:
Encryption: We use encryption technologies to protect data in transit and at rest, ensuring that your data is secure from interception or unauthorized access.
Access Controls: We implement strict access controls to ensure that only authorized personnel can access user data. This includes multi-factor authentication, role-based access, and regular security audits.
Data Minimization: We limit the collection and retention of data to only what is necessary for the purposes outlined in these Terms & Conditions. Unnecessary data is regularly purged from our systems.
Regular Security Audits: We conduct regular security audits and vulnerability assessments to identify and address potential risks to our systems and data.
3.3.2 User Responsibilities
While we take significant steps to protect your data, users also have a role in safeguarding their information. Users are responsible for:
Maintaining Account Security: Users should keep their account credentials confidential and use strong, unique passwords. If you suspect that your account has been compromised, please notify us immediately.
Safe Use of the AI: Users should be cautious about the type of information they input into the AI, especially sensitive or personal data, and should follow our guidelines and recommendations for safe use.
3.3.3 Incident Response
In the event of a data breach or security incident, we will take immediate steps to mitigate the impact, notify affected users, and comply with all relevant legal requirements for incident reporting. Our incident response plan includes measures for containment, investigation, and communication to minimize harm to users.
4. Liability & Disclaimers
4.1 Limitation of Liability
4.1.1 General Limitation
To the fullest extent permitted by applicable law, the Company and its officers, directors, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from:
The use or inability to use our AI product.
Any unauthorized access to or alteration of your data or transmissions.
Any other matter relating to the use of the AI, even if we have been advised of the possibility of such damages.
4.1.2 Maximum Liability
In no event shall our total liability to you for all claims arising from or related to the use of the AI exceed the amount paid by you, if any, for accessing or using the AI during the six (6) months immediately preceding the event giving rise to the liability. If you have not made any payments to us, our total liability shall be limited to one hundred US dollars (USD 100.00) or the equivalent in your local currency.
4.1.3 Exceptions
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such cases, the limitations and exclusions set forth in this section shall apply to the greatest extent permitted by applicable law.
4.2 Indemnification
4.2.1 User Indemnification
You agree to indemnify, defend, and hold harmless the Company, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with:
Your use of the AI, including any content you generate, transmit, or share.
Your violation of these Terms & Conditions or any applicable laws or regulations.
Your infringement of any third-party rights, including but not limited to intellectual property rights, privacy rights, or contractual rights.
4.2.2 Notification of Claims
If we become aware of any claim, demand, or legal proceeding that could give rise to your obligation to indemnify us, we will notify you promptly. You will cooperate fully with us in defending such claims and will not settle any claim without our prior written consent.
4.2.3 Right to Defend
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter subject to indemnification by you. In such cases, you agree to cooperate with our defense of the claim.
4.3 Disclaimers
4.3.1 No Warranty of Accuracy or Completeness
The AI product is provided on an “as is” and “as available” basis without any warranties of any kind, either express or implied. We do not warrant that the AI product will be accurate, complete, reliable, current, or error-free. We expressly disclaim any and all warranties, including but not limited to:
Warranties of merchantability, fitness for a particular purpose, and non-infringement.
Warranties arising from course of dealing, course of performance, or usage of trade.
4.3.2 No Guarantee of Continuous Service
We do not guarantee that the AI product will be available at all times or that access will be uninterrupted or secure. Scheduled maintenance, technical issues, or other unforeseen circumstances may cause temporary interruptions in service, and we disclaim any liability for such interruptions.
4.3.3 Disclaimers Regarding AI Output
The content generated by the AI product may contain inaccuracies, inconsistencies, or content that some users may find inappropriate or offensive. We do not warrant that the AI’s output will be suitable for any particular purpose or that it will meet your expectations. Users are advised to independently verify any critical information provided by the AI before relying on it.
4.3.4 Third-Party Content
The AI may interact with, access, or incorporate third-party content, data, or services. We make no representations or warranties regarding such third-party content, and you agree that we are not responsible or liable for any third-party materials or services, including their accuracy, reliability, or legality.
4.3.5 Limitation of Disclaimers
Some jurisdictions do not allow the exclusion of certain warranties or limitations on implied warranties. In such cases, the disclaimers set forth in this section shall apply to the fullest extent permitted by applicable law.
5. User Responsibilities
5.1 Content Responsibility
5.1.1 Accountability for Generated Content
By using our AI product, you acknowledge and agree that you are solely responsible for the content generated by the AI based on your inputs, including but not limited to text, images, data, or any other material (hereinafter referred to as “Generated Content”). This responsibility includes any consequences that arise from the use, distribution, or publication of such content.
5.1.2 Public Sharing and Commercial Use
If you choose to share or publish Generated Content publicly or use it for commercial purposes, you must ensure that the content does not violate any applicable laws, infringe on the rights of others, or contain harmful, offensive, or misleading information. You agree to take full responsibility for how the content is used, including but not limited to:
Ensuring that the Generated Content complies with intellectual property laws, privacy rights, and any other relevant legal standards.
Appropriately labeling or disclaiming the content as AI-generated, where necessary, to avoid misleading others about its origin.
Avoiding the dissemination of content that could be considered defamatory, fraudulent, or otherwise damaging to others.
5.1.3 Modification and Review of Content
Before using Generated Content in any significant manner, such as in professional, legal, or commercial contexts, you are strongly advised to review, modify, or supplement the content to ensure its accuracy, appropriateness, and legality. We do not assume any responsibility for the accuracy or suitability of the Generated Content for your specific purposes.
5.1.4 Indemnification for Content Use
You agree to indemnify and hold harmless the Company, its officers, directors, employees, and agents from any claims, damages, or liabilities arising from your use, sharing, or publication of Generated Content. This includes, but is not limited to, claims related to defamation, intellectual property infringement, violation of privacy rights, or any other legal issues related to the content.
5.2 Compliance with Laws
5.2.1 Adherence to Legal and Regulatory Standards
As a user of the AI product, you agree to comply with all applicable local, national, and international laws and regulations that govern your use of the AI and the Generated Content. This includes, but is not limited to:
Intellectual property laws: Ensuring that your use of the AI and any Generated Content does not infringe on the copyrights, trademarks, patents, or other intellectual property rights of others.
Privacy and data protection laws: Complying with all applicable privacy and data protection regulations, including those related to the collection, storage, and processing of personal data. You are responsible for ensuring that any personal data included in Generated Content is handled in accordance with relevant legal standards.
Content and communication laws: Abiding by laws related to defamation, hate speech, obscenity, and other forms of harmful or unlawful content. You must not use the AI to generate or disseminate content that violates these laws.
Commercial and advertising regulations: If you use Generated Content for commercial purposes, you must comply with applicable advertising laws, consumer protection regulations, and any other commercial or trade-related laws.
5.2.2 Responsibility for Cross-Border Use
If you access or use the AI from a jurisdiction outside of the Company’s primary operating region, you are responsible for ensuring that your use of the AI complies with the laws and regulations of that jurisdiction. This includes restrictions on the export of certain technologies, as well as compliance with local data protection and content regulations.
5.2.3 Reporting Legal Violations
You agree to promptly report to us any activities or content generated by the AI that may violate applicable laws or these Terms & Conditions. We reserve the right to investigate and take appropriate action, including but not limited to suspending or terminating your access to the AI product and reporting violations to relevant authorities.
5.2.4 Consequences of Non-Compliance
Failure to comply with these legal and regulatory requirements may result in the suspension or termination of your access to the AI product, as well as potential legal action. You agree to bear full responsibility for any legal consequences arising from your failure to comply with applicable laws and regulations in your use of the AI.
6. Termination of Service
6.1 Right to Terminate
6.1.1 Grounds for Termination
The Company reserves the right to terminate or suspend your access to our AI product at any time, with or without notice, for any reason, including but not limited to:
Violation of Terms: If you violate these Terms & Conditions or any other agreements or policies referenced herein.
Prohibited Activities: If you engage in activities that are illegal, harmful, disruptive, or otherwise prohibited under these Terms & Conditions, including but not limited to the misuse of the AI for generating harmful or unlawful content.
Non-Compliance with Laws: If you fail to comply with applicable laws and regulations as required by Section 5.2 (Compliance with Laws).
Threat to Service Integrity: If your actions, whether intentional or unintentional, threaten the security, stability, or integrity of the AI, our systems, or our services.
Inactivity: If your account remains inactive for an extended period, as defined by our inactivity policy, which may result in the suspension or termination of your account.
6.1.2 Immediate Termination
We may terminate your access to the AI product immediately and without prior notice if we believe, in our sole discretion, that your actions pose a significant risk to the security, integrity, or reputation of our services or if required by law.
6.1.3 Effects of Termination
Upon termination of your access to the AI product:
Account Access: You will lose access to your account, including any data, content, or services associated with it.
Cessation of Services: All licenses and rights granted to you under these Terms & Conditions will immediately cease.
No Refunds: Any fees paid for access to the AI product or associated services are non-refundable, except as required by applicable law or explicitly stated in our refund policy.
6.1.4 Appeal Process
If you believe your account was terminated in error, you may contact our customer support team to request a review of your case. We reserve the right to make the final determination regarding the reinstatement of your account.
6.2 Account Deletion
6.2.1 User-Initiated Account Deletion
You have the right to delete your account at any time by following the account deletion process outlined on our website or within the AI’s user interface. If you encounter any difficulties, you may contact our customer support team for assistance.
6.2.2 Effects of Account Deletion
When you delete your account:
Data Deletion: We will permanently delete your account data, including any personal information, user-generated content, and other associated data, within a reasonable timeframe, subject to our data retention policies and legal obligations.
Irreversibility: Account deletion is irreversible. Once your account is deleted, it cannot be restored, and any data associated with it will be permanently lost.
Service Access: You will lose access to all services, features, and content associated with your account.
6.2.3 Retention of Certain Data
Notwithstanding the deletion of your account, we may retain certain data as required by law or for legitimate business purposes, including:
Legal Compliance: Data necessary to comply with legal obligations, resolve disputes, or enforce our agreements.
Anonymized Data: We may retain and use anonymized or aggregated data that does not personally identify you for research, analysis, and product improvement purposes.
Backup Copies: Data stored in our backup systems may be retained for a limited time following account deletion but will be securely deleted in accordance with our data retention and backup policies.
6.2.4 Third-Party Services
If your account is linked to third-party services or platforms, you are responsible for managing and terminating those connections. We are not responsible for any data or content remaining on third-party services after your account with us is deleted.
7. Modification of Terms
7.1 Changes to Terms
7.1.1 Right to Modify
The Company reserves the right to modify, update, or amend these Terms & Conditions at any time, at our sole discretion. Such changes may include, but are not limited to, updates to reflect new features, changes in legal requirements, or modifications to our business practices.
7.1.2 Notification of Changes
We may notify you of significant changes to these Terms & Conditions by any reasonable means, including but not limited to:
Posting the updated Terms & Conditions on our website or within the AI product.
Sending you an email or other electronic communication, if you have provided contact information.
7.1.3 Immediate Effectiveness
Unless otherwise stated, modifications to these Terms & Conditions will take effect immediately upon being posted or communicated to you. It is your responsibility to regularly review the Terms & Conditions to stay informed of any changes.
7.1.4 Material Changes
In the event of material changes that significantly affect your rights or obligations, we may provide additional notice, such as a prominent announcement within the AI product or on our website. We may also require you to affirmatively accept the updated Terms & Conditions before continuing to use the AI.
7.2 User Agreement
7.2.1 Continued Use as Acceptance
By continuing to access or use the AI product after the updated Terms & Conditions have been posted or communicated to you, you agree to be bound by the revised terms. If you do not agree with the updated Terms & Conditions, you must immediately stop using the AI product and may request to terminate your account as outlined in Section 6.2 (Account Deletion).
7.2.2 Rejection of Changes
If you do not agree with any modifications to the Terms & Conditions, your sole and exclusive remedy is to discontinue your use of the AI product. Any use of the AI product following such a change constitutes your acceptance of the revised Terms & Conditions.
7.2.3 Archive of Terms
We will maintain an archive of previous versions of the Terms & Conditions for your reference, which you can request by contacting our customer support team. However, the most current version of the Terms & Conditions will always prevail over any past versions.
7.2.4 Binding Nature
These Terms & Conditions, as modified, constitute a binding agreement between you and the Company. Any changes we make to the Terms & Conditions will not affect your obligation to comply with all applicable laws and regulations governing your use of the AI product.
8. Governing Law & Dispute Resolution
8.1 Governing Law
8.1.1 Jurisdiction
These Terms & Conditions, and any disputes arising out of or relating to them or the use of the AI product, shall be governed by and construed in accordance with the laws of the jurisdiction where the Company is headquartered, without regard to its conflict of law principles. Specifically, the laws of Mumbai, Maharashtra, India shall govern.
8.1.2 Mandatory Application
You agree that the choice of governing law is mandatory and will apply regardless of your location or the location from which you access the AI product. This provision is intended to provide consistency and predictability in the interpretation and enforcement of these Terms & Conditions.
8.1.3 Exclusion of UN Convention
The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply to these Terms & Conditions or any transactions or disputes arising from the use of the AI.
8.2 Dispute Resolution
8.2.1 Initial Resolution Attempt
In the event of any dispute, controversy, or claim arising out of or relating to these Terms & Conditions, the AI, or your use thereof, you agree to first attempt to resolve the matter amicably by contacting our customer support team and providing a written description of your concern.
8.2.2 Binding Arbitration
Arbitration Requirement: If the dispute cannot be resolved informally within thirty (30) days of your notice to us, you agree that the dispute shall be finally settled by binding arbitration in accordance with its Arbitration Rules. The arbitration shall be conducted in Mumbai, Maharashtra, India, unless otherwise agreed by the parties.
Arbitration Process: The arbitration shall be conducted by a single arbitrator with experience in the subject matter of the dispute. The arbitrator’s decision shall be final and binding on the parties, and judgment on the award may be entered in any court of competent jurisdiction.
Costs of Arbitration: Each party shall bear its own costs and expenses, including legal fees, arising from the arbitration, unless the arbitrator determines that the costs should be allocated differently based on the merits of the case.
8.2.3 Class Action Waiver
You agree that any arbitration shall be conducted solely on an individual basis and not as a class, representative, or collective action. No arbitration or proceeding shall be combined with another without the prior written consent of all parties involved.
8.2.4 Exceptions to Arbitration
Injunctive Relief: Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or confidential information.
8.2.5 Venue for Legal Actions
In cases where arbitration is not applicable, or where judicial intervention is required (e.g., to enforce an arbitration award), the exclusive venue for any legal action arising out of or relating to these Terms & Conditions shall be the state or federal courts located in Mumbai, Maharashtra, India. You hereby consent to the personal jurisdiction of these courts.
8.2.6 Waiver of Jury Trial
To the extent permitted by applicable law, both parties waive any right to a jury trial in any legal proceeding arising out of or related to these Terms & Conditions or the use of the AI.
8.2.7 Limitation on Claims
You agree that any claim or cause of action arising out of or related to these Terms & Conditions or your use of the AI must be filed within one (6) months after such claim or cause of action arose, or it shall be forever barred, regardless of any statute or law to the contrary.
9. Third-Party Integrations
9.1 Third-Party Services
9.1.1 Integration with Third-Party Services
Our AI product may integrate with or allow you to connect to third-party services, websites, applications, or platforms (hereinafter referred to as “Third-Party Services”). These integrations are provided for your convenience, and we do not control or endorse any Third-Party Services.
9.1.2 Governing Terms for Third-Party Services
Your use of Third-Party Services is governed solely by the terms and conditions and privacy policies of those third parties. We encourage you to review the applicable terms before using any Third-Party Services. We are not responsible for the content, functionality, accuracy, legality, or any other aspect of Third-Party Services.
9.1.3 No Liability for Third-Party Services

We are committed to continuously improving the AI and addressing issues related to bias and fairness. We may update the AI’s algorithms and training data to mitigate biases and enhance the ethical use of the technology. However, we cannot guarantee complete elimination of all biases.
11. Refund Policy
The cost of the subscription is non-refundable regardless of the reason for the request. It is the sole responsibility of subscribers to cancel their subscription before their billing date if they are not satisfied with the AI product, have not used the AI product, or do not intend to use the AI product.
12. Credits and Accessibility
The credits and access to the AI product provided under your subscription plan are valid only for the duration of your subscription period. If you do not use these credits or access the AI product within this period, they will automatically expire upon the termination of your subscription. We will not provide any compensation, refund, or extension for any unused credits or access that expire at the end of your subscription period.
13. Administrative Fees
Duplicate subscriptions due to an error on the user end are subject to a 6.5% administrative fee (6.5% of the value). This fee covers the non-refundable charges applied by the secure payment processing platform.
